A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

[Criminal Power] On December 30, 2008, the Defendant was notified of a summary order of KRW 700,000 as a crime of violation of the Road Traffic Act in the wooden Branch of the Gwangju District Court.

On November 13, 2019, the Defendant violated the Road Traffic Act (refluoring to take a drinking level) (hereinafter “the Defendant”) received 112 declarations (no.C., “the person who driven a breatob”, and received 15:51 on November 13, 2019), and was called out, and was demanded to comply with a drinking test through a drinking-free place and a drinking-free measuring instrument at around 16:05 on the same day, on the grounds that there are reasonable grounds to believe that the Defendant was driving a breab while under the influence of alcohol due to drinking, statements of witnesses, etc.

Nevertheless, the Defendant refused to comply with the measurement through several times, such as “I will not take measurements, why we see, and what I know.”

As a result, the defendant violated the prohibition of drinking driving or drinking refusal twice or more.

2. He/she shall not operate any motor vehicle on the road that is not covered by mandatory insurance for violating the Guarantee of Automobile Accident Compensation Act, etc.;

Nevertheless, at around 13:08 on Nov. 13, 2019, the Defendant driven a registered d-do which was not covered by mandatory insurance from approximately 1 km to the front road of the same city.

Around 15:30 on December 15, 2019, the Defendant driven an off-registration brea in the state of under the influence of alcohol with approximately 100 meters alcohol concentration 0.162% from the section of approximately 100 meters from the front road located in Sinpo City E to the H road located in Sinpo City G.

2. No person who violates the Guarantee of Automobile Accident Compensation Act shall operate any motor vehicle, etc. on a road which is not covered by mandatory insurance;

Nevertheless, the Defendant is obliged to carry mandatory insurance at approximately 100 meters from the front of the F in E at the time of temporary border, such as Paragraph 1, to the front of H located in G at the time of wooding.
