피고인은 2019. 3. 11. 00:40경 피고인의 주거지인 충주시 B아파트 C호에서 ‘남편에게 맞았다.’는 112신고를 받고 출동한 충주경찰서 D지구대 소속 경위 피해자 E(47세)로부터 인적사항 확인을 위해 신분증 제시를 요구받자 “내가 왜 제시를 하냐, 돌아가라, 내 집에서 나가라.”라고 하며 손으로 피해자의 가슴을 2회 밀친 후 주먹으로 피해자의 가슴 부위를 1회 때리고, 계속하여 공무집행방해죄로 현행범인 체포되는 과정에서 발로 피해자의 왼쪽 정강이 부위를 1회 걷어찼다.
