A defendant shall be punished by imprisonment for not less than eight months.

Seized evidence 4 through 29 shall be confiscated.

Punishment of the crime

【The Defendant, on July 2017, as a foreigner of Chinese nationality, forged a credit card under the name of another person (E, one name “E,” and one name “F”), and purchased valuable goods, such as a name bank, using a forged credit card, and subsequently accepted a proposal from the Defendant to immediately repay the amount borrowed from the Defendant, and then requested the card provider to forge the card with detailed information, such as the card number, validity period, etc. delivered by the above name names, and then requested the card provider to forge the card. Accordingly, the Defendant conspired to take charge of purchasing the purchased goods using the card with the credit card and deliver the purchased goods to the above name names.

[Criminal Facts]

1. No person in violation of the Act on Finance Business specializing in lending credit cards and no person shall use forged or altered credit cards, etc.;

Nevertheless, at around 00:28 on July 4, 2017, the Defendant: (a) taken a victim’s name-free taxi in front of the H hotel located in Gangnam-gu Seoul Metropolitan Government, and calculated taxi fare of KRW 12,240,00 in front of 275, Jung-gu, Seoul, Jung-gu, Seoul, the purpose of which is to be used; (b) provided one of the credit cards (credit card No. 1) forged in collusion with those in name-free boxes, presented it to the above victim as if he was normally issued, and paid the fee; (c) obtained property gains equivalent to the same amount from the victim; and from that date to 14:54 on the same day, from that date, the Defendant used a forged credit card by the same method over a total of 13 times, such as attached Table 2, a total of 8,648,840 won at the market price, or acquired property benefits or made property gains by acquiring property benefits from the victims.
