1. All of the plaintiffs' claims are dismissed.

2. The costs of lawsuit are assessed against the plaintiffs.

1. Basic facts

A. On July 13, 2012, the network E (hereinafter “the network”) concluded an insurance contract with the Defendant for the insurance of KRW 1204, monthly insurance premium of KRW 80,000, monthly insurance premium of KRW 10,000 with the name of the goods, KRW 90,000 with the insurance contract of KRW 90,000 with the death of the injury, ② the name of the goods, KRW 1204, KRW 50,000 with the name of the goods, KRW 50,000 with the monthly insurance premium of KRW 30,000 with the insurance premium of KRW 30,000 with the death of the injury (hereinafter “each insurance contract of this case”). The beneficiary of each of the above insurance contracts is a legal heir.

B. Article 18 of the terms and conditions of each of the instant insurance contracts provides that the insured events under “the intent of the insured” shall be the grounds for exemption from the payment of insurance proceeds. However, the term “the insured’s damage to himself/herself under the condition that he/she is unable to make a free decision due to a defect of mentality, etc.” provides that

C. On March 4, 2015, the Deceased of an accident committed suicide by avoiding a dogb on his own house.

2. Determination as to the cause of claim

A. The terms and conditions of each of the instant insurance contracts stipulate that “the insured has damaged himself/herself in a situation where he/she is unable to make a free decision due to a mental disorder, etc.” as grounds for exemption from insurance proceeds, and the deceased committed suicide while suffering from heavy depression, and thus, the Defendant is obligated to pay the Plaintiffs, the inheritor of the deceased, to the Plaintiffs, who died in the state of mental disorder.
