1. Of the instant lawsuit, the said court rendered a compulsory auction case for ship C with Gwangju District Court Maritime Branch C with respect to the compulsory auction of ship among the instant lawsuit on February 22, 2016.

1. Basic facts

A. On November 4, 2014, the Plaintiff filed a lawsuit seeking the payment of the outstanding amount of KRW 768 million out of the total amount of KRW 310,000,000, which was supplied to Da on November 17, 2012 with the Gwangju District Court Maritime Court 2014Kadan2720, and the Plaintiff was awarded a favorable judgment on November 4, 2014, and the said judgment became final and conclusive as it is.

On May 28, 2015, the Plaintiff filed an application for a compulsory auction with respect to each of the instant fishing vessels to Gwangju District Court Assistance C, and on May 29, 2015, the executing court decided to commence the procedure for compulsory auction (hereinafter “instant procedure for compulsory auction”).

On February 22, 2016, a court of execution prepared a distribution schedule stating that the amount of KRW 91,804,648 to be distributed actually on the date of distribution of the procedure for compulsory auction of this case was as follows. However, the plaintiff raised an objection against the amount of distribution of the defendant, and filed the lawsuit of this case on February 29, 2016.
