[2018 고단 2127] 피고인은 2018. 4. 15. 경 안산시 상록 구 E, 501호에 있는 자신의 주거지에서, 컴퓨터를 이용하여 인터넷 네이버 ‘F’ 카페에 접속한 후 ‘ 에어 팟 블루투스 이어폰을 판매한다’ 는 내용의 글을 게시하고, 이를 보고 연락해 온 피해자 G에게 “ 나의 농협 은행 계좌( 계좌번호 : H) 로 125,000원을 입금하면 에어 팟 블루투스 이어폰을 보내주겠다 ”라고 말하였다.

그러나 사실 피고인은 에어 팟 블루투스 이어폰을 보유하고 있지 아니하였을 뿐 아니라 위와 같이 돈을 입금 받더라도 이를 자신의 생활비 등에 소비할 계획이었으므로 피해 자로부터 돈을 받더라도 위 기기를 보내줄 의사나 능력이 없었다.
