A defendant shall be punished by imprisonment for four months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[2015 Highest 312] On September 26, 2014, at a place where it is difficult to know a specific place at the time of racing, the Defendant posted a letter stating that “The Defendant will send Blus earphones to the post office dispatch if it transfers KRW 40,00 to the victim C who visited the Defendant using the Defendant’s mobile phone to the “number open store,” which is the direct transaction site of used goods in the Internet, and then posted a letter stating that “Blus earphones will be sold.”

However, even if the defendant receives money from the victim C, he did not have any intention or ability to send Blus earphones.

Nevertheless, as seen above, the Defendant received 40,000 won immediately from the victim C as the price for the goods, from March 18, 2015, from that time to March 19, 2015, and received 1,882,00 won in total as the price for the goods from the victims as indicated in the crime list.

[2015 Highest 493] On November 21, 2014, the Defendant posted a letter stating that “The Defendant will send a contact ticket if he transfers KRW 246,500 to the victim D who contacted the Defendant by using a mobile phone at a place where the specific place is unknown, and then connected to the N.S. Highest 16:00.”

However, even if the defendant received money from the victim D, the defendant did not have any intention or ability to send the contact diskettes as promised.

Nevertheless, the Defendant, as seen above, received a false statement from the victim D to transfer KRW 246,50 as the price for the goods on the same day.

In addition, from that time until December 30, 2014, the Defendant received KRW 1,208,50 in total as the price for goods from the victims nine times, such as the statement in the crime sight table.
