A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Punishment of the crime

1. In using and managing a means of access as of July 10, 2019, no person who violates the Electronic Financial Transactions Act shall borrow or lend a means of access, or keep, deliver or distribute a means of access by requesting or promising to receive compensation, unless otherwise specifically provided for in any other Act.

Nevertheless, around July 9, 2019, the Defendant received a proposal that “if the Defendant sent a credit card with a large amount of balance of the accounts used for the lending that may cause problems to the Defendant without permission, the Defendant would loan KRW 10 million if it is confirmed that the credit card was put into ATM machine and the amount of the deposit would normally be paid,” and then, on July 21, 2019, at the Busan National University Hospital located in Seo-gu, Seo-gu, Busan National University, Seo-gu, Busan National University, 179, the Defendant’s wife, which was connected to B (C) account in the name of the Defendant, provided that the Defendant was a four-way card number and the nameless person was sent by telephone to the nameless person.

Accordingly, the Defendant promised to provide compensation and lent the means of access.

2. In using and managing a means of access as of July 13, 2019, no person who violates the Electronic Financial Transactions Act shall borrow or lend a means of access, or keep, deliver or distribute a means of access by requesting or promising to receive compensation, unless otherwise specifically provided for in any other Act.

Nevertheless, the Defendant lent one e-mail card connected to the Defendant’s name B account, and then deposited KRW 2 million with the above account on July 11, 2019, and KRW 7 million in total on two occasions each time, respectively.
