A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.

Punishment of the crime

On April 27, 2016, the Defendant was sentenced to imprisonment of one year and six months for fraud in the Busan District Court's Dong Branch Branch, and the judgment became final and conclusive on August 20, 2016.

On November 27, 2012, the Defendant promised to pay KRW 50,750,00 to B part of the share of “Seopo City P” at KRW 50,750,00, and received KRW 53,461,50 from B, the Defendant was willing to create the appearance of transfer of ownership of the said share of land to B when the ownership of the said share was transferred from the Plaintiff, which received the said payment, or the purchase price was not refunded.

1. On March 28, 2013, the Defendant forged official document: (a) at the FF Co., Ltd. office operated by the Defendant on the Busan Jin-gu, Busan, Busan, and the second floor; (b) at the Jeju District Court’s office, copied the written information and the notice of completion of registration, such as the name of the agency, such as the Seopo District Court’s Seopo registry; (c) deleted the portion below the right holder; (d) deleted the portion of the right holder into the title column; and (e) deleted the registration number column from the right column; (d) “B”; (e) “G; (e)” in the registration number column of the PA205/903 of the Busan Metropolitan City Organization, Busan; (e) “I”; and (e) in the registry number column of real estate; and (e) “I” in the Jeju Special Self-Governing Province and the date of receipt”; and (e) “17171”; and (e) “the date of registration transfer” in the column of receipt; (iii. 2.3.

Accordingly, the defendant forged the written information and the notice of completion of registration, such as the name of the agency such as the Jeju District Court Seopopool registry office, which is an official document.

2. The Defendant forged private documents at the date, time, and place specified in paragraph (1), copied a certificate of a right to registration under the name of a certified judicial scrivener J-office, and then stated the right holder portion as “B” in the category of the right holder column with a shot-type color pen, and stated “B” in the same manner, “in Seopo-si, Seopo-si, Jeju Special Self-Governing Province,” and “date” in the column.
