Defendant shall be punished by a fine of 3.5 million won.

If the defendant fails to pay the above fine, 50,000 won shall be one day.

Punishment of the crime

around 15:53 on May 13, 2012, the Defendant posted an article on the PC website located in Daegu-gu, Daegu-gu, stating that the victim E would purchase a cultural product right of KRW 100,000,000 on the PC website, and made a false statement on the victim’s payment of KRW 90,000,000 by telephone to the effect that “The right of cultural products will be granted if deposits KRW 90,000 are paid.”

However, even if the defendant receives money from victims, he did not have the intention or ability to transfer cultural products rights.

The Defendant received 90,000 won from the victim to the Agricultural Cooperative Account under the name of the Defendant as the price for cultural products.

Accordingly, the defendant was given property by deceiving the victim.

1. On July 9, 2012, around 03:07, the Defendant: (a) posted a letter stating that the Victim F will purchase four copies of shower D website; and (b) sent letters to the victim’s cell phone as if the Defendant received money from the victim, to the victim’s mobile phone as if he would give the victim’s ticket.

However, even if the defendant received money from the victim as the price for a ticket, he did not have an intention or ability to give a victim with a ticket.

The Defendant received 80,000 won from the victim to the national bank account under the name of the Defendant at around 03:22 on the same day.

Accordingly, the Defendant was given property by deceiving the victim as above.

2. Around July 17, 2012, the Defendant: (a) posted a statement on the victim G on the Internet NAVD website stating “heat tampet is inserted;” and (b) sent the victim’s cell phone as if the victim were to receive money from the victim, to the victim’s cell phone.

However, even if the defendant received money from the victim as the price for a ticket, he did not have an intention or ability to give a victim with a ticket.

The defendant shall be the same day from the victim.
