Defendant shall be punished by a fine of KRW 5,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

1. On July 16, 2016, the Defendant posted a false statement to the effect that, around July 16, 2016, at the Defendant’s residence located in Yeonsu-gu Incheon Metropolitan City Ctel 926, the Defendant sold the NAV bulletin board “D” using a mobile phone owned by the Defendant, and that, on the part of the victim E who reported and contacted the letter, “I will send the 30,000 won if you transfer the 30,000 won first.”

However, even if the defendant receives money from the victim, he did not have any intention or ability to send the money to the victim.

Nevertheless, the Defendant, by deceiving the victim as above, received 30,000 won from the account of community credit cooperatives (Account Number:F) in the name of the Defendant on the same day.

2. On July 27, 2016, around July 27, 2016, the Defendant posted a false statement to the effect that “I will sell at a discounted rate of 10% cultural product rights” on the Defendant’s cell phone bulletin board,” and that “I will send 100,000 won for the transfer of KRW 90,00 to the victim G who reported and contacted the statement.”

However, the defendant did not have the intention or ability to pay reasonable cultural products rights to the above amount.

Nevertheless, the Defendant, by deceiving the victim as above, received 90,00 won from the victim to the above account of community credit cooperatives under the name of the Defendant on the same day.

3. On July 29, 2016, the Defendant posted a false statement on the place indicated in paragraph (1) around July 29, 2016, to the effect that “I sell Grand gift certificates” on the Defendant’s cell phone bulletin board “Neman Republic of China”, and that I would send Grand gift certificates to the victim H who reported and contacted the letter “I will send KRW 240,000,000 to KRW 30,000,000 if the transfer was made.”

However, the defendant is true.
