A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is a person who has been accommodated in the victim D (n, 59 years old) in Jeju-si Office 308 in a long time.

1. 2013년 3월경 범행 피고인은 2013년 3월경 위 여관 1층의 카운터 내실에 있는 피해자에게 찾아가 “내 이야기 좀 들어 달라”고 하면서 피해자를 로비에 있는 소파로 나오게 하여 피해자와 위 소파에 앉아 피해자에게 이런저런 이야기를 건네다가, 피해자에게 성욕이 생겨 갑자기 손으로 피해자의 오른손을 붙잡아 당겨 피고인의 성기 부위 옷 위로 가져다 대고, 이에 피해자가 깜짝 놀라 피고인에게 “뭐하는 짓이냐”고 하면서 피고인의 손을 뿌리치려 하자 재차 양손으로 피해자의 오른손을 붙잡아 당겨 피고인의 성기 부위 옷 위에 대고 세게 누르면서 움직이지 못하게 하여 피해자를 추행하였다.

2. 3. From July 2013 to July 2013, the Defendant: (a) requested cleaning to the victim who was cleaning on the third floor of the lower part of the said 2013, and (b) made cleaning by entering the above 308 room toilets in which the Defendant was living; and (c) collected the victim’s hand at the lower part of the victim’s half-sides; and (d) caused the loss to avoid the victim’s body, and (e) caused the loss to the victim.
