2. 피고인은 2013. 9. 일자불상 15:00경 위 학교 1층 복도에서, 혼자 걸어가고 있는 피해자에게 다가가 손을 붙잡고 위와 같은 방법으로 피해자의 손바닥에 뽀뽀를 한 후, 이를 거부하며 바로 옆 수돗가에서 손을 씻는 피해자에게 다가가서 “뭐가 찝찝하냐”고 말을 하며, 피고인의 손바닥으로 피해자의 엉덩이를 두드리는 방법으로 2회 만져 신체적ㆍ정신적인 장애로 인하여 반항이 곤란한 피해자를 추행하였다.
