피고인은 속칭 보이스 피 싱 사기단의 총책인 성명 불상자( 위 챗 대화명 ‘D’) 와 성명 불 상의 보이스 피 싱 사기단의 일원들과 함께 국내외 불특정 다수인에게 전화로 대출업체를 사칭하는 방법으로 자신들이 지정하는 계좌에 돈을 이체하도록 하거나, 불법으로 취득한 개인정보를 이용하여 인터넷 뱅킹 등의 방법으로 돈을 송금 받는 등의 금융 사기 범행을 하기로 마음먹고, 보이스 피 싱 사기단의 총책인 ‘D’ 는 대포 통장의 모집 ㆍ 전달, 피해 금의 인출 및 타 계좌로의 송금 방법 등을 지시하는 총책의 역할을, 피고인은 보이스 피 싱 피해 금을 인출해 주고 그 대가로 인출 금의 5%를 받기로 하고 현금을 인출하여 이를 타 계좌로 송금하는 역할을 각 담당하여 피해 자로부터 보이스 피 싱 방법으로 금원을 편취하기로 순차 공모하였다.
