1. The Defendants shall jointly and severally serve as the Plaintiff the amount of KRW 40 million from December 27, 2008 to October 18, 2017.
Reasons
1. On December 27, 2008, the Plaintiff indicated the claim and lent to Defendant B the amount of KRW 40 million at the interest rate of KRW 25% per annum under Defendant C’s joint and several sureties, and the Defendant did not pay that amount.
Accordingly, the Plaintiff’s claim for the payment of KRW 40 million and its interest, from December 27, 2008, to December 27, 2008, the lease date, 5% per annum under the Civil Act, and 15% per annum under the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings from the next day to the date of full payment.
2. Article 208 (3) 1 of the Civil Procedure Act of the applicable provisions of Acts.
