Defendant shall be punished by imprisonment for not less than two years and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Criminal facts

1. Violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (Taking pictures, such as cameras);

A. On May 28, 2017, around 08:33, the Defendant, while having sexual intercourse with the victim D (V, 37 years of age) who was under guard at the Defendant’s home located in Busan East-gu C703, Busan-dong, 2017, taken three times as the Defendant’s cell phone, in which the victimized person was living together with the Defendant’s sexual organ.

2. The Defendant: (a) sent the images taken from around 21:05 on June 10, 2017 to around 03:46 on the following day to the victim; and (b) if the Defendant did not talk with the victim, he/she would distribute the pictures to his/her family, workplace, etc.

Intimidation, around June 30, 2017, on the part of the victim's house, the victim's arrest was made, and the victim's arrest was made.
