1. 성폭력범죄의 처벌 등에 관한 특례법위반( 통신매체이용 음란) 피고인은 2014. 3. 6. 00:00 경부터 01:00 경까지 사이에 불상의 장소에서 ‘D’ 이라는 E 밴드에 피해자 F( 여, 16세 )를 초대한 후 위 밴드 게시판에 “ 넌 자지( ) 사진 보면 아무 느낌두 없어 ”, “ 사진 있는 거 좀 올려봐 ㅋㅋㅋ 보고 시퍼 ㅠ” 이라는 글을 올리고, 남성과 여성의 성기 사진, 여성의 성기에 도구가 삽입되어 있는 사진, 여성이 남성의 성기를 핥는 사진을 올리고, 이어서 위 밴드의 대화 창 기능을 이용하여 피해자에게 “ 자위나 하 까”, “ 가치 하실 !!”, “ 나랑 폰 섹 하장” 등의 글을 전송하였다.
