A defendant shall be punished by imprisonment with prison labor for up to six months.

Punishment of the crime

around December 21, 2014, the Defendant: “2015 Godan1521”, using a mobile phone at a place where the address of Gwangju (hereinafter referred to as the “Seoul”) is unknown; (a) connected by using a mobile phone display system to the “number store”, which is a used goods transaction site; and (b) expressed a statement to the effect that he would sell opphone6 used goods.

On the same day, the defendant reported the above writing to the victim C, who expressed his intention to purchase, made a false statement that he would sell the used goods of 360,000 won to the victim C.

However, even if the defendant receives the above money from the victim, he did not have any intention or ability to sell used goods for the second time.

Nevertheless, the Defendant: (a) by deceiving the victim as above, received money of KRW 3.60,00 from the victim to the Nong Bank account (Account Number E) in the name of mobile phone sales proceeds on the same day; and (b) obtained money totaling KRW 9,254,500 from 30 victims as the sales proceeds of used goods, etc. from 30 victims, including the transfer of money of KRW 3.60,00 from the victim to April 11, 2015.

Around January 2, 2014, the Defendant posted a letter to the effect that he would sell gold booms (18 km) to the “ballter”, a trading site of used goods.

On the same day, the Defendant reported the above writing to the victim F, who expressed his intention to purchase, made a false statement to send 50,000 won to the victim F, 18k gold bullion.

However, even if the defendant received money from the victim, he did not have the intention or ability to send the goods.

Nevertheless, the Defendant, by deceiving the victim as above, received 50,000 won from the victim under the name of 18k gold bullion on the same day and acquired it by deceiving the victim.

The Defendant, around April 22, 2014, posted a letter to sell otoba on the Internet “number changeter” at a non-permanent place in Seo-gu, Seo-gu, Gwangju, and then sent money to G with the victim who reported and contacted this letter.
