Reasons
Punishment of the crime
around September 28, 2015, the Defendant posted a false statement that he/she had access to a mobile phone at a place where the place is unknown and sold Aphone6, a transaction site of used goods via the Internet, and sold Iphone6. On September 28, 2015, the Defendant made a false statement that he/she would send Iphone6 if he/she first transfers money to the victim F, who reported and contacted the notice, and on September 28, 2015, the Defendant was transferred KRW 600,000 from the victim to the Agricultural Cooperative Account in the name of G (H: Account Number).
However, since the defendant thought that living expenses, etc. were prepared and the defendant did not have the opphone6 to be delivered to the victim, even if he received money from the victim, he did not have the intention or ability to send the opphone6 to the victim.
Accordingly, the Defendant, as such, obtained property by deceiving the victim and acquired it, and then acquired 3,750,000 won in total by the same method nine times from May 18, 2016, such as the attached crime list (1).
Around March 1, 2016, the Defendant posted a letter “sale of Aphone 6 Popphone 348” on the Internet’s bulletin board, a trading site of used goods via a mobile phone at Popon-si and Popon-si (hereinafter referred to as “Sopon-6 Popon-Son-Son-Son-Son-Son-Son-Son-Son-Son-Son-Son-Son-Son-Son-Son-Son-Son-Son-Son-Son-Son-Son
However, in fact, the Defendant did not have any goods sold, and was thought to use the goods for living expenses with money from the victim, so there was no intention or ability to sell the goods to the victim from the beginning.
Ultimately, the Defendant, as such, deceiving the victim and transferred KRW 500,000 from the victim to the Agricultural Cooperative Account under the J as the price for goods on the same day. From that time to May 1, 2016, 8 times in total, as shown in the separate list of crimes (2).
