가. 원고는 1977. 4. 18. 육군에 입대하여, 1980. 1. 17. 만기전역(병장)한 사람으로서, “훈련소 4주차 실탄 사격훈련 중 첫발을 쏘는 순간 양쪽 귀에서 쩡 하는 충격을 받은 이후 양쪽 귀에 이명이 계속 들리기 시작하였고, 1979. 10월 포병 근무 당시 한미연합훈련에 참가하여 TOT사격(동시탄착사격)시 발생하는 엄청난 폭발음에 재차 귀에 충격을 받은 이후 청력이 급속도로 나빠지기 시작하였다”고 주장하며, “양측 감각신경성 난청, 이명”(이하 ‘이 사건 상이’라 한다)을 신청 상이로 하여 국가유공자등록 신청을 하였다.

B. After deliberation and resolution by the Board of Patriots and Veterans Entitlement, the Defendant rendered the instant disposition against the Plaintiff on March 7, 2016, on the grounds that “no specific and objective evidence to acknowledge that the instant injury occurred while serving in the military is verified” did not meet the requirements for persons who rendered distinguished services to the State and persons eligible for veteran’s compensation.

2. Whether the disposition is lawful;

A. The difference in this case occurred after participating in the KOT shooting training in the military training center and the KOT shooting training in October 1979 at the time when the plaintiff's two arguments were entered without anything, and participated in the KOT shooting training in the KOT shooting (Dong TOT shooting). Thus, the difference in this case is likely to have a proximate causal relation with the military duty or education and training.

B. (1) The determination requires a proximate causal relationship between performance of duties or education and training to constitute “a wound in the course of performing duties or education and training” under Article 4(1)6 of the Act on the Honorable Treatment of and Support for Persons, etc. of Distinguished Services to the State and Article 2 Subparag. 2 of the Act on Support for Persons Eligible for Veteran’s Compensation.
