A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. At around 15:00 on June 9, 2019, the Defendant forged an official document forgery and forged a motor vehicle registration certificate under the name of the head of Seo-gu Incheon Metropolitan City, which is an official document under the name of the head of Seo-gu Incheon Metropolitan City, using the registration certificate form in the name of the head of Seo-gu Incheon Metropolitan City, which was stored at the computer for the purpose of the second sale of the vehicle at the office of "B" in Seo-gu, Seo-gu, Incheon, to enter the "C", "Neis", "E", "F" into the owner column, and output it by using a printer connected to the above computer, thereby forging one registration certificate under the name of the head of Seo-gu Incheon Metropolitan City, which is an official document under the name of the Gu, and thereby forging the performance inspection register under the name of the G Association.
2. On June 9, 2019, the Defendant, at around 15:40 on June 15, 2019, presented one registration certificate, a private document under the name of the head of Seo-gu Incheon Metropolitan City, which is a public document under the name of the head of Seo-gu Incheon Metropolitan City, and one copy of the inspection record of the performance status of used cars, which is a private document under the name of the G Association, to the said J, a guest who purchased used cars in front of the first street located in Seo-gu Incheon Metropolitan City, as if he could sell the used cars at KRW 29.8 million at the market price.
3. Where a motor vehicle dealer who violates the Motor Vehicle Management Act sells a motor vehicle or assists in sale, he/she shall notify in writing the details of inspection of performance and condition of structure, devices, etc. of the motor vehicle, seizure, registration of mortgage, etc.
Nevertheless, the defendant prepared a false statement to J as described in paragraph (2).
