A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On July 2019, the Defendant forged public document documents: (a) made entries on the registration certificate form in the name of the head of Seo-gu Incheon Metropolitan City, which has been secured through the Internet search using the Pototool program, such as the car registration number, car name, owner name column, etc. recorded on the registration certificate form in the name of the head of Seo-gu Incheon Metropolitan City, which has been secured to attract customers to sell used cars; (b) entered the vehicle registration number column into the car registration number column, “E”, “E”, “F (association)”, “F (association)”, “S”, “B”, and “S” in the owner’s name column; and (c) entered the specifications corresponding to the said model into the mobile storage device, stored the file in the mobile storage device, and then output the registration certificate voluntarily prepared by using the PC computer in the PC unit in Seo-gu Incheon Metropolitan City, Seo-gu.

Accordingly, for the purpose of exercising, the defendant has forged one registration certificate in the name of the head of Seo-gu Incheon Metropolitan City, which is an official document.

2. On July 2019, the Defendant taken photographs of a forged motor vehicle registration certificate using a mobile phone, and sent the photograph to H as if he/she were a true motor vehicle registration certificate.

Accordingly, the defendant exercised forged official documents.

3. A person who intends to conduct motor vehicle transaction business in violation of the Motor Vehicle Management Act shall register with the head of a Si/Gun/Gu;

Nevertheless, at around 18:30 on July 20, 2019, the Defendant arranged the purchase and sale of a motor vehicle by introducing and explaining Dbenz vehicles to purchase a motor vehicle at the first floor J store in Seo-gu Incheon, Seo-gu, Incheon.

Accordingly, the defendant carried on the automobile transaction business without registering it with the competent authorities.
