Reasons
Punishment of the crime
The Defendant, who actually operates C, D, E, and F, a real estate construction company, and was registered as an internal director of the above corporation, did not obtain consent from G, the previous year in transferring 13,500 shares of the above corporation possessed by G to H.
1. Forgery of private documents;
A. On July 31, 2013, the Defendant, at the Defendant’s office located in Busan Metropolitan City, Busan Metropolitan City, stated that “G in the name column of the transferor,” “J in the address column,” “K in the resident registration number column,” and “C, in the case of the transferor, transfer of KRW 1,000 per common share to H in the company, at the Defendant’s office located in the Busan Metropolitan City, Busan Metropolitan City.” On July 31, 2013, the Defendant marked that “G”, “J in the name column of the transferor,” “K in the resident registration number column,” and marked a G seal.
Accordingly, for the purpose of exercising, the Defendant forged a certificate of stock transfer and receipt in the name of G, a private document on rights and obligations.
B. The Defendant above A.
In the paper of the certificate of stock transfer and takeover at the same time and place as in paragraph (1), ‘G' in the name column of the transferor, ‘J' in the address column, ‘K' in the resident registration number column, and ‘K' in the general share of 7,500 shares of Company E shall be transferred to the transferee H one thousand won per share, and the seal of G held in advance in the name of the transferee was affixed.
Accordingly, for the purpose of exercising, the Defendant forged a certificate of stock transfer and receipt in the name of G, a private document on rights and obligations.
C. The Defendant above A.
In the paper of the certificate of stock transfer and takeover at the same time and place as in paragraph (1), ‘G' in the name column of the transferor, ‘J' in the address column, ‘K' in the resident registration number column, and ‘K' in the transferred G shall transfer 2,500 common shares of Da Co., Ltd. to the transferee H one thousand won per share, and affix a seal of G which is held in advance next to that name.
