A defendant shall be punished by imprisonment for four months.

Punishment of the crime

[Criminal Records] On May 18, 2016, the Defendant was sentenced to imprisonment with prison labor for the commission of a forged official document, etc. at the Daegu District Court on May 18, 2016 and the said judgment became final and conclusive on May 26, 2016.

[2] The Defendant, without obtaining the consent of C, who is the actual operator of a mobile phone sales store, concluded a pre-paid mobile phone opening contract with D without obtaining the consent of C, and tried to illegally open the pre-paid mobile phone in another person’s name and sell the heart.

1. Forgery and events of an agency contract;

A. On December 2, 2013, the Defendant entered into a contract for the opening of the prepaid mobile phone with D Co., Ltd. without the consent of the actual operator of C at a “F” mobile phone sales store working for the Defendant located in Guro-gu Seoul Metropolitan Government, and entered into a contract for the opening of the prepaid mobile phone with D Co., Ltd., Ltd. using a non-scriptive tool in the contractor’s trade column, stating “F”, “Seoul Guro-gu Seoul Metropolitan Government E”, and “G” in the representative column, and had been kept at will next to the name of the Defendant.

Accordingly, for the purpose of uttering, the Defendant forged one chapter of agency contract in G name, which is a private document on rights and obligations.

B. At once and at the same time, the Defendant: (a) delivered the forged agency contract to D Staff H, Co., Ltd., which was aware of the forgery, as if it were duly formed; and (b) exercised it.

2. Forging and events of a prepaid mobile phone contract;

A. On July 22, 2014, the Defendant: (a) made use of the paper for a new pre-paid mobile phone/title change contract, which was kept in the said F agency; (b) stated “I” in the column for new subscription number; and (c) signed the “J” at will in his/her name on the customer column; and (d) signed the “J” at will in his/her name.

Accordingly, the defendant, for the purpose of uttering, has forged the prepaid mobile phone contract in the name of J, which is a private document on rights and obligations.
