1. Defendant A shall be punished by imprisonment for eight months.
However, the above sentence shall be executed for a period of two years from the date this judgment became final and conclusive.
Reasons
Punishment of the crime
1. Defendant A and B’s joint crime is a person running the “E Game Center” in Incheon City D, and Defendant A is a person who transferred the said Game Center to Defendant B around March 2020.
The Defendants were willing to submit a lease agreement by forging F to the department in charge of viewing the game room business in order for Defendant A to transfer the above game room business to Defendant B, when the submission of “BA lease agreement entered as a lessee of the building in question.”
A. On March 2020, the Defendants forged private document: (a) in the instant game room in which the Defendant used a verification-type pen to indicate “1.0,000 won per month”; (b) in the column where “1.0,000 won per month” was located; (c) in the column where “134.19,” in the size column; and (d) in the column for structure and use of dry water column, the Defendants entered “one million,10,000,000,” and “F” in the column for guarantee of contract deposit; and (d) in the column for guarantee of contract deposit, the Defendants entered the “F’s seal” in the column; and (e) the lessor sent the leased property to the lessee by February 4, 2020; and (e) the lessor’s deposit into the account by February 21, 2014; and (e) the lessor’s deposit into the account by the end of each month.
A, who is the full-time officer, took over B’s successor, entered “K-ho, the lessor’s resident registration number column,” “L” and “F” in the lessor’s name column in the lessor’s lawsuit, and entered “M” in the lessee’s name column, “N andO” in the lessee’s resident registration number column, “P” and “B” in the lessee’s name column, and entered “B” in the lessee’s name column.
As a result, the Defendants conspired to do so, one copy of the lease contract for real estate in the name of lessor F, a private document on rights and obligations.
