Punishment of the crime

1. Violation of the Electronic Financial Transactions Act (the part on the acquisition of means of access);

A. On July 4, 2016, around 14:00, the Defendant: (a) taken two passbooks in the bank account (Account Number: E,F) of the National Bank in the name of D on a mobile phone from the closed-gu Busan Metropolitan City Gold-gu C Studane; (b) and one security card; and (c) obtained Internet banking IDs and their passwords from D by mobile phone text messages.

Accordingly, the Defendant acquired the means of access to electronic financial transactions.

B. The Defendant received two physical cards and one OTP from D at the same place in the same month after reporting the loss thereof from D, and received the Internet banking ID and its password from D by mobile phone text messages.

Accordingly, the Defendant acquired the means of access to electronic financial transactions.

C. On the 25th day of the same month, the Defendant received two physical cards and one OTP from the said bank account that was reissued after having reported the loss thereof from D at the same place, and received the Internet banking ID and its password from D by mobile phone text messages.

Accordingly, the Defendant acquired the means of access to electronic financial transactions.

On the 27th day of the same month, the defendant was issued to D, on the 27th day of the same month, a note with D containing the name of the defendant's bank account (Account Number G) and the deposit account number, Internet banking ID and its password, etc.

Accordingly, the Defendant acquired the means of access to electronic financial transactions.

2. Violation of the Electronic Financial Transactions Act (the assignment of the means of access to electronic financial transactions);

A. On July 2016, the Defendant’s name cannot be identified through Kwiksetset Service on the front of the said studio (Kwiksetel)-B.
