A defendant shall be punished by imprisonment for not less than two years and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. The Defendant violated the Electronic Financial Transactions Act, along with D, collected a passbook from the so-called Bosing fraud organization that committed the crime by using the passbook, and collected a certain fee, and then advertised D’s Internet website to the effect that “on the face of a page the means of access, such as a passbook and a cash card and password connected to the passbook, it would be given the price.” The Defendant reported the advertisement, received the passbook, etc. from those who contacted D, and distributed D the same to receive the said fraud fee again.

After the Defendant conspiredd with D as above, on November 2013, the Defendant received the means of access by receiving each passbook, Internet banking security card, electronic financial transaction confirmation, cash card, physical card, password, etc. connected to the Kwikset through Kwikset Service from a person who reported and contacted the above advertisements in active service near Gangnam-gu Seoul Metropolitan City.

B. After the Defendant conspired with D as above, on November 201, 2013, from the person who reported the above advertisement and provided communication in the area near Gangnam-gu Seoul High Military Branch, Kwikset Service received the means of access by receiving each passbook, Internet banking security card, electronic financial transaction confirmation, cash card, physical card, password, etc. connected to H’s post account (Account Number: I) and new bank account (J).

C. After the Defendant conspired with D as above, around December 10, 2013, the Defendant received the means of access from a person who reported the above advertising and had contacted in the vicinity of the Gangnam-gu Seoul Metropolitan area area through Kwikset Service by receiving Kwikset’s passbook, Internet banking security cards, electronic financial transaction confirmation cards, cash cards, physical cards, passwords, etc. connected to Kkwikset’s Agricultural Account.
