Punishment of the crime

피고인은 2005.경부터 인터넷 게임 회사인 주식회사 넥슨(이하 ‘넥슨’이라 한다)이 운영하는 ‘어둠의 전설’ 게임 동호인 모임인 온라인 커뮤니티 ‘D’를 운영하였다.

The Defendant managed the above online community and held the personal information of its members (the name of the subscriber, the name of the subscriber, resident registration number, the date of issuance of resident registration certificate, e-mail, telephone number, address, and the names of game character, etc.). On 2009, the Defendant intruded into another person’s “pre-permanent game account” game using the above personal information, and gathered with E, etc. to raise profits by exchanging another person’s items.

피고인은 보유하고 있던 위 온라인 커뮤니티 회원들의 개인정보를 E에게 전달하고, E은 일부 개인정보가 부족하거나 실제 정보와 일치하지 않아 게임 계정 해킹을 위해 추가 정보가 필요할 경우에는 동사무소에 전화해서 ‘온라인상 전입신고에 필요하다’는 등의 허위 사유를 대고 자신들이 보유하고 있던 개인정보를 이용하여 추가 정보를 입수하고, 이를 통하여 확보한 타인의 게임 아이디와 주민등록번호 등 개인정보를 이용하여 넥슨 ‘어둠의 전설’ 사이트에 접속한 후 비밀번호 초기화 신청을 하고, 초기화된 비밀번호를 미리 지정된 이메일 또는 핸드폰으로 전송받은 후, 타인의 ‘어둠의 전설’ 게임 계정에 아이디와 초기화된 비밀번호를 입력하고 무단으로 접속하여 계정 내의 자료를 열람한 후 계정에 보관되어 있던 게임 아이템을 피고인과 E이 관리하는 게임 계정으로 이동시켜 환전한 후 나눠가지기로 모의하였다.
