Defendants are innocent.

Reasons

Indictment

1. Defendant A is an employee of the South-dong E Company E in the Nam-gu Seoul Metropolitan City.

No person shall dump excreta, livestock excreta, animal carcass, wastes, or sludge in a public water area without justifiable grounds.

A. On September 25, 2016, around 07:00, the Defendant discharged a waste (i ton of finished products maintaining animal nature) into a public water zone (river) and contaminated a waste (i.e., a finished product maintaining animal nature) by carrying out work without locking the valves of a storage tank lower part of the tank during the work process.

B. On December 17, 2016, at around 16:30, the Defendant discharged, into public waters, waste water generated in the course of the corruption of waste dead bodies stored in the open air, which were disposed of by avian influenza (animals water).

As a result, the Defendant committed an act of dumping wastes (unusable finished products, animal carcasses, etc.) in public waters (river).

2. Defendant B Co., Ltd. is a corporation established for the purpose of maintaining animal nature.

At the above time and place, the Defendant, as seen above, had the Defendant thrown away wastes (the finished products maintaining animal nature, the body water of animals) from the public waters (rivers).

Judgment

1. The instant public prosecution was instituted to the effect that “the finished product that maintains animal nature” constitutes “waste” in the determination related to the discharge of finished products that maintain animal nature.

Inasmuch as the Act on the Conservation of Water Quality and Water Quality does not provide for the definition of "waste", it is inevitable to use the definition of "waste" under the Waste Management Act ( Meanwhile, Article 15 (1) 2 of the Act on the Conservation of Water Quality and Water Quality as indicated in the applicable provisions of the Act provides that "the designated waste under the Wastes Control Act is excluded from "waste", and that the definition of "waste" is clearly defined as "waste management Act."
