Defendant shall be punished by a fine of five million won.
If the defendant does not pay the above fine, KRW 100,000.
Reasons
Punishment of the crime
The Defendant is the actual representative of C Co., Ltd. in Pyeongtaek-si B, and C is the company whose permission was revoked on September 17, 2014 when it obtained a comprehensive waste recycling business license.
1. Where the Minister of Environment or the Mayor/Do Governor orders a waste treatment business operator to revoke his/her license, he/she shall order the waste treatment business operator or the person who has reported the disposal of wastes in custody for a specified period, and the person who has received such order shall comply therewith;
Nevertheless, the Defendant did not dispose of the entire quantity of wastes stored in the said C site from Pyeongtaek-si Office until June 30, 2016, even though he was served by Finding D on early 2016, even though he was served on him, until June 27, 2017.
2. A person who intends to dispose of wastes in violation of the Wastes Control Act (the point of discharging industrial effluents) shall ensure that wastes are not scattered or leaked in the course of collection, transportation, or storage, prevent the water from being scattered or leaked, and where the water is produced, such wastes shall be treated as prescribed by Ordinance of the Ministry of Environment and shall not be contaminated with the surrounding environment;
Nevertheless, the defendant contaminated the surrounding environment by discharging water from wastes that have not been disposed of as referred to in the above paragraph 1-A.
3. No person who violates the Act on the Conservation of Water Quality and Aquatic Ecosystems shall throw excreta, livestock excreta, animal carcass, wastes, or sludge in a public water zone;
Nevertheless, the defendant's failure to treat wastes like the above Paragraph 2 of the above, caused rainwater to occur by discharging waste, and did not treat wastewater in an appropriate manner, so that it can flow it into neighboring agricultural waterways, which are public waters.
