The Defendant is among the Plaintiff 309 square meters prior to Pyeongtaek-si D:
(a)Annex 1, 2, 3, 4, and 1, respectively.
Reasons
1. Basic facts
A. On March 25, 198, the Plaintiff completed the registration of ownership transfer on the ground of the completion of repayment on March 19, 1988 with respect to 309 square meters prior to Pyeongtaek-si D (hereinafter “the Plaintiff’s land”). From that time, the Plaintiff occupied and used the Plaintiff’s land as a tree tree planting site.
B. For the purpose of constructing a new building on January 31, 2007, the Defendant: (a) purchased KRW 561 square meters adjacent to the Plaintiff’s land; (b) completed the registration of ownership transfer on the said land on February 1, 2007; and (c) divided the said land into KRW 406 square meters before E on March 15, 2007 and KRW 155 square meters before F; (b) around February 26, 2007, the Defendant completed the registration of ownership transfer from the Defendant’s land category of “after completing the registration of ownership transfer on June 27, 2007,” the Defendant obtained the registration of Defendant’s land category from the Defendant’s land as “after completing the registration of ownership transfer on the instant land.”
C. At the time of the construction of the Defendant’s building, the Defendant completed a report on the development and utilization of groundwater of this case to the competent authority on March 29, 2007.
