A A shall be punished by a fine of 3,000,000 won, Defendant B shall be punished by a fine of 1,000,000 won.
The above fine is imposed against the Defendants.
Reasons
Punishment of the crime
1. On December 29, 2018, the Defendants: (a) around the new wall on December 29, 2018, the Defendants were committing the crime involving the accident, and (b) around 19th century, were travelling along with Defendant A’s Drocketing car; (c) even though the occurrence of a traffic accident was not actually occurred, the Defendants conspired to have the Defendant receive insurance proceeds from the insurance company, referring to the occurrence of a traffic accident, and the occurrence of a traffic accident.
Accordingly, at around December 29, 2018, Defendant A reported a false traffic accident to the victim E, the insurer of the motor vehicle comprehensive insurance for the said rocketing car at the above location, stating, “A, at around December 29, 2018, there was a traffic accident that shocks the driver who passed the crosswalk in the Sungsung City, at around 02:14, the victim E, who is the insurer of the motor vehicle comprehensive insurance for the said rocketing car.” Defendant A notified Defendant B of the traffic accident victim.
In addition, on January 2, 2019, Defendant B received medical treatment or hospitalized treatment by pretending to have undergone the aforementioned traffic accident, and on January 3, 2019, Defendant B agreed with the employees of the victim association and the traffic accident agreement with the employees around that time.
From February 1, 2019, the Defendants deceptiond the staff in charge of the victim union and had the victim union pay KRW 45,240 and KRW 462,090 for medical expenses at F and G hospital. On January 4, 2019, the Defendants acquired the total amount of KRW 1,407,330 by remitting the agreed amount of KRW 90,000 to Defendant H account at Defendant B’s H account.
2.
