Reasons
Punishment of the crime
Defendant A, along with accomplices C, E, B, and F, intended to have intentionally caused a traffic accident, and deceiving an insurance company, and to divide the insurance proceeds therefrom. Defendant A, who was in charge of leading roles, such as purchasing vehicles to use for the crime, providing them with information on the method of the crime, notifying the accomplices of the method of the crime, and soliciting the rest of the accomplices to share the roles such as “insurance solicitation” recruited by drivers and passengers, “ drivers” who intentionally cause a traffic accident by driving a vehicle directly, and “persons on board the vehicle” who receive insurance proceeds from the insurance company.
[Specific Crime]
1. On March 20, 2019, the Defendant: (a) around March 20, 2019; (b) purchased G lap vehicles from G and provided them with information about the method of the crime; and (c) while driving the vehicle from the NorthIC in the North Daegu-gu, Daegu-gu, Daegu-gu, to enter the said vehicle in Newcheon, the Defendant: (a) was driving the vehicle on the said vehicle; (b) the I driver’s JN-si vehicle’s JN-si vehicle’s driver’s car driver’s seat change from the secondary line to the primary line was partially cut off to the front part of the said lap vehicle; and (c) was charged with the said lap vehicle’s car going ahead by the said NAS vehicle, and caused a traffic accident by intention to have the said chip vehicle in succession, which had been driven by the said NAS vehicle.
Nevertheless, C, E, B, and H, while engaging in a traffic accident as if they were due to negligence, claimed each insurance money from the victim P and the victim P, and their affiliation from the victim company from March 26, 2019 to May 31, 2019, damage the agreement amount, medical treatment, repair cost, etc. with respect to traffic accident-related persons who are required to receive insurance money from the victim company from March 26, 2019 to May 31, 2019.
