Reasons
Punishment of the crime
1. No person who violates the Rearrangement of Agricultural and Fishing Villages shall illegally occupy or use agricultural infrastructure without justifiable grounds, such as cases where urgent measures are necessary for the prevention of damage caused by natural disasters and for lifesaving;
Nevertheless, around June 25, 2014, the Defendant illegally occupied agricultural infrastructure by planting 45 glue trees, such as main trees, into ditches, which are agricultural infrastructure located in Incheon Strengthening-gun C.
2. Obstruction of general traffic;
