1. Defendant A shall be punished by imprisonment with prison labor for one year;

2. Defendant B shall be punished by imprisonment for six months.

Punishment of the crime

At around 03:30 on September 12, 2013, the Defendants, at the main point of “H,” where the victims G (31 years of age) working in the F 3th floor in Suwon-gu, Busan, the Defendants: (a) had Defendant B and Defendant C, who was a part of society, look at the existence of the victim G, on the ground that he did not listen to the victim G, even though he retired from his business on the part of the above main point through the card of Chapter 7 from the above main point.

Since then, Defendant B and Defendant C confirmed the existence of the victim G and the victim I (the age of 32) within the above main point, and then contacted Defendant A with them and informed them of this situation.

이에 피고인 A는 주점으로 찾아가 “모두 일어서라”고 하여 피해자 등을 한쪽으로 모이도록 한 후 기선을 제압하기 위해 덩치가 큰 피해자 I을 상대로 “건달도 아닌 사람이 여기 왜 있는데”라며 양쪽 주먹으로 피해자 I의 얼굴 부위를 수회 때리고, 계속해서 이를 말리던 피해자 G의 얼굴부위를 머리로 들이받았으며, 이로 인해 피해자 G가 코에서 피를 흘리며 주방으로 씻으러 가자 뒤따라 들어가 “내가 분명히 장사하지 말라고 했는데 무시하나”라며 오른쪽 발로 피해자 G의 왼쪽 정강이부위를 찼다.
