1. 피고인 A, 피고인 D, 피고인 E의 공동범행 피고인들은 2012. 4. 3. 21:30경 피해자 G가 운영하고 있는 부산 중구 H주점 내에서, 앞서 피고인 A이 2012. 2. 1. 22:30경 위 주점에서 피해자에게 주점 운영권을 넘겨주면서 그에 대한 계약조건으로 보증금 300만 원과 가게 월세 350만원을 기일 내에 갚지 못할 경우 각 매일 이자 30만원씩 붙는다는 차용증을 부동산임대차계약서의 특약 조건으로 작성하였는데, 이후 피해자가 영업부진 등의 이유로 위와 같이 체결된 계약조건의 채무를 이행하지 못하자 피고인 A은 “내돈 내놔라 씨발년아, 개같은년아, 니는 여자만 아니었으면 벌써 죽었다. 내가 너희집까지 얘들 보내놨다”라며 욕설과 행패를 부리다가 그곳 테이블 위에 있던 휴지각을 피해자를 향해 집어 던지는 등 위협하였고, 피고인 D, 피고인 E는 위와 같은 피고인 A의 행위에 겁을 먹고 있는 피해자의 뒤쪽에 나란히 앉아서 피해자를 째려보듯 위력을 과시함으로써 피해자가 공포심과 불안감을 유발케 하였다.
