A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The Defendant is a person who operates a livestock product processing business and communications sales business with the trade name of “C” in Sincheon-si B, and sells processed livestock products, such as “D” and “E”, and foods for camping, etc. on his own website.
1. A person who intends to operate a livestock product processing business without permission shall have legitimate facilities for each place of work and obtain permission from the competent authority, as prescribed by the Enforcement Rule of the Livestock Products Sanitary Control Act;
Nevertheless, from December 9, 2014 to October 13, 2015, the Defendant manufactured and sold “D” 2,122,400 won in total in the market price of 83,200 won in D” 208 (93.6km) processed livestock products, which are processed livestock products, without obtaining permission from the competent authority, at the office of “C” from around December 9, 2014 to around October 13, 2015. The Defendant manufactured and kept the total market price of 83,200 won in D” 8 (3.6km) and kept them for sale.
2. Where any livestock product for sale purposes of which the distribution deadline expires, an industrial operator shall not sell livestock products, or process, process, pack, use, import, store, transport or display such products for sale purposes, for which the distribution deadline indicated on the relevant livestock products expires;
Nevertheless, around October 13, 2015, the Defendant: (a) manufactured around August 25, 2014 at the office of “C” operated by the Defendant; (b) stored at around KRW 12,224,086 of the total market price of livestock products 11-type 600.28 km for which the distribution deadline has lapsed, with the aim of selling 203 km-Wing-C-Wing-Wing-Wing-C-Wing, and (c) stored at around KRW 12,086 of the total market price of livestock products 12,224,086.
3. Any person who marks falsely the distribution deadline.
