A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

On August 10, 2011, the Defendant was sentenced to six months of imprisonment for fraud in the Daejeon District Court, and completed the execution of the sentence in the Daejeon Prison on September 13, 2011.

1. On June 10, 2012, the Defendant assaulted the victim at one time when the victim D (the age of 18) reported the Defendant’s drinking driving to the police on the Defendant’s drinking operation in front of the Damo (the age of 18) on June 10, 2012.

2. 공용물건손상, 공무집행방해 피고인은 제1항 기재 일시, 장소에서 위와 같이 음주운전 신고를 받고 출동한 충북 괴산경찰서 E지구대 소속 경사 F(42세)이 현장에서 음주측정을 거부하는 피고인을 음주측정을 하기 위해 위 지구대로 데려가려고 G SM3 112 순찰차량에 태우자 ‘이 개새끼야, 빨리 가야 될 것 아니냐’고 소리를 지르며 주먹과 발로 위 차량의 조수석 뒷유리와 뒷좌석을 여러 차례 차고, 계속하여 위 F이 위 순찰차량의 운전석에 탑승하여 운전하려고 하자 발로 F의 등을 1회 걷어찼다.

3. 모욕 피고인은 2012. 6. 10. 21:30경 충북 증평읍 교동리 63에 있는 충북 괴산경찰서 E지구대 사무실에서, 위 지구대 소속 경장인 피해자 H(35세)이 피고인을 상대로 음주측정을 하려고 하자 D, 자율방범대원 I, J 등이 있는 자리에서 피해자를 향하여 ‘야이 씨발새끼야, 야이 씨부랄놈들아, 그래 개새끼야, 확 불게, 씨발놈아’라고 큰 소리로 말하여 공연히 피해자를 모욕하였다.
