Reasons
Punishment of the crime
1. C’s joint criminal conduct with C, and C’s mobile phone sales agency by fraud, opened a mobile phone in the name of another person, and received it and conspired to sell it to third parties.
Accordingly, at around 14:00 on August 12, 2014, the Defendant issued a cell phone agency located in Seo-gu, Seo-gu, Seo-gu, Seo-gu, Seo-gu, Seo-gu, the Defendant issued his identification card and family relation register to the victim F, who is occupying the phone, and “to open a cell phone in the name of Ho-gu, to open the cell phone in the name of Ho-gu, once the phone is changed from the cell phone,” and “A” made a false statement to the effect that “to open the cell phone in the name of Ho-gu, once the phone is changed from the phone number received from the Defendant,” and “to accept the cell phone opening”.

Defendant and C, as such, deceiving the victim, was delivered two mobile phones from the victim, namely, at the gallon, the sum of the market value of KRW 1,799,600.
2. On August 19, 2014, the Defendant’s sole criminal defendant stated that “I” mobile phone agents located in Seo-gu, Seo-gu, Seo-gu, Seo-gu, Seocheon-gu, Seo-gu, Seocheon-gu, stated that “I allowed the opening in the name of each type G, so that each type of opening was allowed.”
However, the defendant did not have obtained permission on the opening of a mobile phone from G, and he thought that he received a mobile phone from the victim and disposed of it to a third party.
The Defendant, as such, by deceiving the victim, received two mobile phones S5 mobile phones from the victim, namely, a total of 1,799,600 won in the market value.
