Defendant shall be punished by a fine of three million won.
If the defendant does not pay the above fine, KRW 100,000.
Reasons
Punishment of the crime
1. Fraud;
A. A. On September 25, 2014, the Defendant made a false statement to the victim C’s agency operated by the victim C in the Chungcheongnam-gun B of Chungcheongnam-do, the Defendant: (a) did not intend or have an ability to sell a mobile phone or settle the cost thereof; and (b) did not sell a mobile phone to the victim and settle the cost thereof.
Accordingly, the Defendant, by deceiving the victim as above, received property amounting to KRW 1,819,40,00 in total, including two chips equivalent to approximately KRW 1,79,600 in the market price and two chips equivalent to approximately KRW 19,80 in the market price.
B. Around September 26, 2014, the Defendant made a false statement to the F Office located in Yellow-gu, Chungcheongnam-gu, Chungcheongnam-gu, that “If the victim pays the vehicle sirens, he would do so only if he would do so.”
Accordingly, the Defendant, by deceiving the victim as above, had the victim settle the vehicle siren cost of KRW 370,000, and acquired financial benefits equivalent to the same amount.
C. On October 2, 2014, the Defendant made a false statement to the D agency operated by the victim C, in the 19:47 U.S. B, that “A would sell a mobile phone or settle the cost thereof, and the Defendant did not have any intention or ability to sell a mobile phone,” and that “A victim would sell a mobile phone and settle the cost thereof.”
Accordingly, the Defendant, by deceiving the victim as above, received property amounting to KRW 2,786,30,00 of the total sum of 2,786,30,000 chip chip amounting to approximately KRW 1,79,60,00 in gallon city, approximately KRW 957,00 in gallon city, and approximately KRW 957,00 in gallon city, and acquired it.
2. A thief: (a) around October 2, 2014, the Defendant: (b) committed DNA agents run by the victim C in the Chungcheongbuk-gun; (c) arbitrarily, without the victim’s permission, thefted KRW 14,000 of the cash owned by the victim.
