A defendant shall be punished by imprisonment with prison labor for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The defendant is not a person handling narcotics.
1. Purchasing philophones;
A. On November 5, 2014, at around 07:41, the Defendant remitted the purchase price of 1.50,000 won to the Japanese bank account in the name of D used by C, and then purchased approximately 0.03g of psychotropic drugs from C, on the roads front of the Gyeongwon School located in the Busan Seosan-dong, Busan, at around 11:00 on the same day, the Defendant purchased them.
B. On November 22, 2014, the Defendant remitted the purchase price of 1.50,000 won to the Japanese bank account in the above D’s name, and purchased 0.03 grams from C at the front of the “F Hospital” road located in Busan Shipping Daegu on the same day, around 13:32, around the same day, the Defendant purchased 0.03 grams from C.
C. On December 13, 2014, the Defendant remitted the purchase price of KRW 100,000 to the Japanese bank account in the above D name on December 13, 2014, and purchased approximately 0.03 grams from C in the “H Hospital” toilet located in Jin-gu Busan, Jin-gu, Busan on the same day, around 19:28.
On January 28, 2015, the Defendant remitted the purchase price of 100,000 won to the Japanese bank account in the above name D, and then purchased approximately 0.03 grams from C in front of the “ Conceion Center” road located in Busan, Busan, Daegu, Do governor-dong on the 15:02 following day, and purchased 0.03 grams from C.
2. Medication of phiphones.
A. On November 7, 2014, the Defendant administered six male toilets in Busan Shipping Daegu, with approximately 0.03 grams of philopon, using a one-time injection device for the Defendant’s arms.
B. At around 03:00 on October 8, 2015, the Defendant administered approximately 0.03 grams in the place of residence of J in Busan, Nam-gu, Busan, in the same manner as the above paragraph (a).
