A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. The Defendant is a person running a Korea-Japan trading business. The Defendant purchased a lawsuit from a livestock farmer to pay a certain amount of money, and then received a grading after slaughter, and operated a large-scale distributor to sell the difference again. However, from around 2011 to around 201, the difference remains as at the time of slaughter with respect to the lawsuit purchased from a large-scale distributor at a lower grade due to the domination of the foot-and-mouth, and the cumulative amount of KRW 300 million remains as losses. Ultimately, even if the Defendant purchased the lawsuit from the victims of the situation where the Plaintiff did not pay the small amount of money received from the distributor and paid it to another livestock shed, there was no intent or ability to pay the price.
Nevertheless, on August 29, 2012, the Defendant, at a farm operated by the victim C in Chungcheongnam-gun, Chungcheongnam-gun, Chungcheongnam-gun, stating that “The purchase price for selling the factory to B is to be paid immediately after the following day or following the following day,” received approximately KRW 7.3 million from the victim C, and was issued KRW 48 million at a total of six times from around that time to September 21, 2012, as shown in the list of crimes in the attached Table.
2. The Defendant is a person who, after purchasing a lawsuit from a livestock farmer, slaughters the lawsuit and receives a grading, sells it to the distributor, and engages in a sales business of milk.
Around 18:00 on September 23, 2012, the Defendant made a false statement to the victim E’s stable in Hongsung-gun, Hongsung-gun, Hongsung-gun, stating that “A lawsuit is urgently required before the prosecution is made, and the lawsuit is requested, and the payment will be made on the following day with the lawsuit.”
However, in fact, the defendant receives a lower grade in the litigation that he purchased from the breeder to the highest grade due to the influence of the footer, and the difference is the damage.
