Defendant shall be punished by a fine of KRW 4,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

In order to enter a dry field of one’s own cultivation, the Defendant: (a) 2014 high-level 399 [2014 high-level 399]; (b) even though the land owned by the victim C was passed by the Changwon Masan-si, the Defendant installed a chain and other structures at the same place to remove the structures at his/her own discretion so that the passage through the facilities would not be left; and (c) around November 12, 2013, the Defendant cut off the chain installed on the said land and the lock market price of KRW 987,000, and harming its usefulness from that time until December 27, 2013 as shown in the attached crime list, such as impairing the utility of the chain owned by the victim and the lock market price of KRW 3,729,000,000 from that time to December 27, 2013.

1. A person who intends to convert a mountainous district shall obtain permission from the Administrator of the Korea Forest Service, etc. according to the classification of mountainous district types, size, etc. prescribed by Presidential Decree;

Nevertheless, from July 2013 to March 2014, the Defendant converted the use of mountainous districts by excavating and damaging land of approximately KRW 780 square meters by means of removing trees with mechanical saws on mountainous districts restored to forests without permission from the competent authorities for conversion of mountainous districts for not less than 30 years without permission.

2. Any person who intends to temporarily use a mountainous district shall report to the Minister of the Korea Forest Service or the head of a Si/Gun/Gu;

Nevertheless, around April 20, 2014, the Defendant laid off and excavated the land using the digging season without reporting temporary use to the competent administrative agency, and created an access road with 112.5 square meters as an access road.
