The crime of concealment of evidence in the holding is a fine of KRW 5,00,000 against the violation of each public official election law in the judgment of the defendant.

Punishment of the crime

[2016 Gohap 24] L was a candidate for the 20th National Assembly election (hereinafter “20th National Assembly election”) as the chairperson of M Co., Ltd. (hereinafter “M”). Defendant A was a candidate for the 20th National Assembly election (hereinafter “20th National Assembly election”). Defendant A was a person who served as the head of the entire supporters’ association (the head of the supporters’ association after detention) of L candidate from June 2015 and served as the head of the actual election campaign office of LA and O election campaign; P was a person who was an employee of Q Q (hereinafter “ Q”) operated by Defendant A as the former accountant in charge of the above supporters’ association, and R was a person who worked at the O election campaign from October 9, 2015 to work at the O election campaign.

1. Violation of the Public Official Election Act [Violation of the Election Campaign Period (Prior Election Campaign)] (including the name, photograph, telephone number, academic background, and career (including political career) while acting as the head of L from June 2015, the Defendant committed an election campaign to increase the support rating and personal guidance by making L’s name, photograph, telephone number, academic background, and career (including political career) use T-ray symbolizing S party, and identifying and adjusting the schedule of events in the local constituency. After having identified and adjusted the schedule of events in the local constituency, L had an intention to conduct an election campaign to increase the support rating and personal guidance by visiting various events held in the local constituency with the Defendant or other execution sources to introduce himself

A member of the National Assembly may conduct an election campaign from six days after the deadline for registration of candidates to the day preceding the election day, and no election campaign shall be conducted when it is not during the election campaign period.

Nevertheless, the defendant and L are in accordance with the above mother:

A. L, on August 6, 2015, visited W Games held in NAV located in Chungcheongnam-gun N in U around 19:00 to 20:00, and distributed the name cards to many unspecified electors while engaging in personnel affairs;

B. Around 11:00 on September 11, 2015, L visited the Z festival held in the Y in the above X and distributed the above name cards to the general public for an unspecified number of election districts;

C. On October 1, 2015, 10:00, the Defendant and L, together, to the Chungcheongnam-nam OA.
