A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

C In the election of the 20th National Assembly members implemented on April 13, 2016, on December 15, 2015, in the election of the 20th National Assembly members, registered as a preliminary candidate for the E political party affiliated with the E political party on December 15, 2015, and the Defendant is the person who was supported by the said c preliminary candidate.

No one shall make contributions for a candidate in connection with an election, and no one shall make an election campaign except as prescribed by the Public Official Election Act before March 31, 2016 through April 12, 2016, which is an election campaign period, and no one shall distribute printed matters indicating the name of a candidate, except as prescribed by the Public Official Election Act, from October 16, 200 to April 13, 2016, which is 180 days before the election day.

Nevertheless, the Defendant provided meals, such as food, to voters for the above C prior to the election campaign period, and attempted to distribute the first register for the establishment of the above C election campaign office, which is scheduled to be held on January 16, 2016.

1. On January 9, 2016, the election campaign period, around 18:00, the Defendant provided meals to 20 residents in the “G” restaurant located in Jinju-si, Seoul-si, and the election district, including H, by dividing them into the first place register for opening the election campaign office of the above C, and had the above C distribute the personnel and name to the residents of the above constituency, and at the same time, the Defendant provided 250,000 won of the meals to the above election district residents in the name of his husband by paying them by the agricultural cooperative card in the name of his husband, and distributed printed materials by unlawful means.

2. On January 10, 2016, the Defendant provided meals to 10 residents in the “J” restaurant located in Jindo-si around 12:00 on January 10, 2016, the election campaign period for the Defendant: (a) divided the above C’s election campaign office’s first ceremony register, etc.; and (b) distributed the said C’s personnel management and name to the residents of the said constituency; and (c) distributed KRW 160,000, the meal expenses of the said residents of the said constituency, under the name of the Defendant.
