Reasons
Punishment of the crime
In the election of the 21st National Assembly member of the National Assembly implemented on April 15, 2020, the Defendants were those who were elected as a candidate for the party F of the E constituency and were the election office members of the G candidate elected.
No one shall make door-to-house visits for an election campaign, and distribute, post, spread, screen or run an advertisement, letter of personnel management, poster, photograph, document, drawing, document, drawing, printed matter, recording tape or others similar thereto, which includes contents supporting, recommending or opposing a political party or candidate's name, or which indicates the name of a political party or candidate's name, in order to influence an election from 180 days before the election day to the election day.
1. Defendant A and B, together with the Defendants, visited the house of this Chapter I located in H around April 3, 2020 and delivered one copy of the name cards indicating the G candidate’s name to appeal for support for the G candidate. From April 2, 2020 to April 3, 2020, Defendant A and B visited the house of a resident in the constituency in I, K, and L to seek support for the G candidate, or, in the absence of a person at home, sent the name cards of G candidate by mail. In order to carry out an election campaign, the Defendants visited the entire 11 household for each election campaign, and distributed the name cards indicating the candidate’s name in order to have an effect on the election.
2. Defendant C, at around April 2, 2020, placed a name tag indicating the name of G candidate on the front floor of the entrance. From that time to April 4, 2020, Defendant C expressed the name of the candidate in order to have an effect on the election by asking for the support of G candidate among the residents of the constituency in the O and P zone, or by placing a name tag indicating the name of the candidate in front of the house entrance of the electoral residents.
