1. Defendant B Co., Ltd.: (a) 356,944,539 won and its relation to the Plaintiff, from December 31, 2012 to October 31, 2014.

1. Basic facts

A. (1) The relationship between the parties (1) The Plaintiff used two Dongs (hereinafter “instant burning building”) from among the building D, E-ground buildings in ancient city as a logistics warehouse by leasing them from F, G, etc., a right holder of the said building, to a company engaged in the development, manufacture, sale, etc. of new materials.

(2) Defendant B Co., Ltd. (hereinafter “Defendant Company”) leased and used as a factory the H above ground buildings (acquisition of ownership on March 2, 2004; hereinafter “instant fireproof building”) owned by Defendant C, the representative director of the company that is engaged in the business of manufacturing literature, etc.

B. (1) On December 31, 2012, a fire was reported to the Japanese fire fighting unit around 09:58 on the same day as the fire occurred in the instant fire fighting building.

(2) At the time, Defendant Company I, who had been working in the front container office of the instant fireproof building, was reported to the effect that the instant fireproof building was postponed, and became aware of the fire that it had to be fire. Although Defendant Company attempted to extinguishing with other employees of the Defendant Company and the manual fire extinguishers, it failed to extinguishing the fire in a fluent length.

(3) At around 10:08 on the same day, when a fire-fighting vehicle arrives at the first fire site, the point of compliance room in the instant fire-fighting building had been strong in the state where the fire growth engine had already started and it was in the front and in the first aspect, and a large-scale inspection from the second freedom in the vicinity of the instant fire-fighting building was to be observed.

(4) Although the fire fighting team attempted to extinguish a fire with the cooperation of fire fighters, etc. in the vicinity of the mountain fire fighting team, the fire of this case was larger than the size of the fire of this case, and as soon as the burning speed was high, a considerable portion of the buildings nearby the fire of this case, including the burning building of this case, was destroyed by a fire at around 13:25 on the same day.
