A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

1. On June 2012, the criminal defendant against the victim C made a false statement to the effect that “it shall conduct business via the Internet, but if it lends KRW 60,00,000 to the victim as it is necessary to pay money, it shall be repaid within two months after adding the principal and interest to the victim.”

However, the Defendant prepared the Internet illegal activities at the time, but did not have any financing plan required for the specific project plan or the project, and there was no ability to procure human resources, equipment, etc., and even if the Defendant received money from the victim, there was no idea to invest in the project, and there was no intention or ability to repay the money within the agreed period, even if the Defendant borrowed the money from the victim as operating expenses for the project.

On July 11, 2012, the Defendant: (a) by deceiving the victim as above; (b) received KRW 30,000,000 from the Defendant’s bank passbook (Account Number: D) in the name of the Defendant; and (c) obtained a total of KRW 54,20,000 on five occasions as shown in attached Table 1; and (d) around July 13, 2012, he/she obtained a total of KRW 10,00,000 from the Yongsan-gu Seoul, Yongsan-gu, Seoul; and (b) obtained a volume of goods equivalent to KRW 10,050,000 from the Sejong Computer Co., Ltd., Ltd. and exempted the payment of the said amount, as shown in attached Table 2, from paying the said amount.

2. Around August 2, 2012, the Defendant made a false statement to the effect that “If the Defendant borrowed KRW 20,000,000 as it is necessary to pay money to the victim to operate an online casino with a license for online casino business, he/she would pay the principal with the interest of KRW 200% within two months.”

However, the defendant is online at that time.
