A defendant shall be punished by imprisonment for not less than two months.

Punishment of the crime

1. The defendant's fraud against the victim BW, even though the victim BW opened a mobile phone under his/her name, he/she was thought to sell the mobile phone immediately to meet his/her living cost, and did not intend or have the ability to pay the mobile phone price. However, around April 25, 2014, the defendant obtained the victim's mobile phone BY ELS agency located in Gangnam-gu Seoul Metropolitan Government from the victim in order to secure funds by opening the cell phone through the cell phone and selling the cell phone. The defendant received the mobile phone price and the user fee of the opened cell phone from the victim in the same manner as the victim stated in the separate crime list from April 28, 2014, and obtained the victim's total market price of KRW 366,800,000, which was opened under his/her name from the victim to April 28, 2014.

2. The Defendant against the victim CA, even though the victim CA opened a cell phone under the name of the victim CA, did not think that the mobile phone was sold immediately to meet living expenses, and did not have the intent or ability to pay the cost of the mobile phone. However, around April 28, 2014, the Defendant obtained the victim’s purchase of the mobile phone by means of opening the cell phone and securing the funds from the victim at the Gangnam-gu Seoul Metropolitan Government BX around April 28, 2014, stating that “The cost of the mobile phone opened through the opening of the cell phone will be paid instead of the cost of the cell phone and the fee for the use of the cell phone will be paid instead of the victim.” The Defendant received the cell phone (CC) of an amount equivalent to KRW 716,800, the market price opened in the name of the victim from May 28, 2014, and obtained the amount of the total market price of KRW 2,860,100 in the same manner as the attached crime list 2 from the victim.
