1. The Defendant shall pay to the Plaintiff KRW 26,162,448 as well as 20% per annum from February 4, 2016 to the day of complete payment.
Reasons
1. Even if the Plaintiff was to provide his labor at the Defendant Company from September 15, 2014 to January 20, 2016, and retired, the Defendant did not pay the unpaid wages of KRW 21,758,042 and retirement allowances of KRW 4,404,406 until 14 days from the date of retirement.
Therefore, the Defendant is obligated to pay to the Plaintiff damages for delay at the rate of 20% per annum from February 4, 2016 to the date of full payment, which is the day following the expiration of 14 days from the date of retirement, to the day of full payment.
2. Judgment based on the recommendation of confession (Article 208 (3) 2 of the Civil Procedure Act).
